Click and type in a question or comment I just got done with Shattered.....what horrible evil human beings David and Heather Temple...two selfish, no-good low life people who are both responsible for the cold blooded death of Belinda Lucas Temple. They won't have to answer to God because they both are going straight to hell. KC: It is an upsetting case, for sure. Tragic and sad. ******************* You are a master of words and story telling. I could not put down your book "Shattered". I read it in two days and could feel the emotions of all involved. Have ordered more of your books through Amazon and plan to read everything you write from now on. KC: Thanks so much. Whoever you talked to about David and his family gave you the truth. They were always covering up for him. I saw it first hand. He'd get in trouble, and they'd stonewall and explain it away, and because he was a star football player, nothing was ever done. LOL ***************** Kathryn - Can you explain how Heather Temple is able to keep custody of Evan? Are the Lucas' able to see him and/or have visitation rights? It seems so unfair and it seems like the Lucas family continues to suffer blow after blow. Amber KC: My understanding is that the Lucas's have some court-ordered rights, but the visits are very short and infrequent, and they're never alone with Evan. They meet in a public place. I've also been told that David signed papers saying he wanted Heather to have custody. Doesn't seem fair, does it? ******************** I just finished reading Shattered......wow....I truly believe he did kill poor Belinda! Finally, she and Erin got justice...I hope he rots in prison!!!!!! KC: Glad you enjoyed the book. ************************ Hi Kathryn - I know the question about David Temples appeal has been answered, but I wanted to take it a step further. Correct me if I'm wrong, but considering the fact that the appeals court stated publically that the appeals process typically takes about 60-90 days to decide, doesn't that give you the impression the court must feel there's at least some validity in the defendants grounds for appeal? Further, as each day goes by with no decision, is your opinion on whether or not the appeal will be granted affected at all? If so, how? Thanks in advance for your feedback - BJT KC: Dear BJT: I don't know what the judges are thinking. I've learned not to assume anything, just like I don't guess what a jury will do. I've followed appeals that dragged on for years that went no where and others that took a long time and were finally reversed. Does this make you question - who actually killed Jennifer ? KC: No. I've seen no evidence that even suggests Laura Hall was in the apartment at the time Jennifer was murdered. I'm sure you read more books than I can write, since it takes me a year to turn one out. So I don't see a problem recommending authors I believe in, and Ann is, of course, at the top of the list. As to Texas, I've kind of settled in down here and, so far, I haven't had to leave. The unfortunate truth is that there's always an amazing case unfolding in Texas. I just finished a "Warrant To Kill," and I wondered it Kent McGowen was ever found guilty and if he is serving the time he deserves. Also, if his family lived to win a Civil Judgement in the case. The book really angered me, because it seems that the psychopaths hold all the cards while the victim goes unheard. KC, not only did you tell Linda Bergstrom's story, ..you went the extra mile and talked with the monster..and at the very end ..let him know that he was not fooling you or anyone else. It was my first you know, back then called THE RAPIST'S WIFE. Funny story: I did a book signing at a store in Houston for that book, and the place is an old theater with a big marquee. They advertised it and ran the first two words together, so the marquee read: THERAPIST'S WIFE. A bunch of folks came in thinking I'd written a book about being married to a psychiatrist. I love seeing justice done at the end of your books, but in the case Kent McGowen I was so disheartened that he didn't go to jail for Susan White's murder. What is the current status of this case? The books take a long time to write, and I interview around 100 people for each, so it's wonderful to hear that the effort is toward a good end. The twins are doing well. Both defendant's were about as guilty as one can be although one case was purely circumstantial. It is amazing to me how Piper showed absolutely no remorse for her actions and just outright denied every piece of evidence laid out in front of her. Her defense would have been better suited to an insanity argument or laying out all of her issues (mental health / losing her kids etc.) to lessen her punishment but she was just to egotistical to take that route. McGowen just had some issues that made him even more dangerous behind the badge and it is truly sad that he was a police officer and used that to carry out cold blooded murder. He told me there is a professional hit out on this former deputy. Just recently I saw A&E's rebroadcast of the Mcgowan/White case. I'm pretty sure Mcgowan is the deputy I was told about. It gave me goose bumps when I realised that. It's hard not to conclude that Mcgowan deserves what will be coming to him, though. If you email me at kc@kathryncasey.com, I'll pass it along for you. *** Dear Ms Casey, I just viewed the "Justice Files" based Kent McGowen. I am an academic (a retired nurse) and have always read. I was quite personally affected by the final outcome of one policeman's dishonesty and crimes. I went through a similar situation, but on a minor scale from the murder victim. I was manhandled by a policeman in the Utah surburb where I was living. I was attempting to collect my personal belongings with the protective assistance of an assigned police officer. I had finally left my husband of many abusive years. He wasn't the first assigned but in this primarily male-controlled state I had been assigned a majority of egotistical officers who showed an obvious distain for women and exhibited their feelings freely. I am 4'11" and my only reaction would become frustration and hysteria. This, of course, would serve to fuel the agressive reactions of the officers towards me. Numerous times I was disrespectfully spoken to and could never retrieve my belongings in one trip, necessitating a repeat reassignment of another officer. This also created a police resentment for having to reassign another officer to a "hysetrical woman".(The suburb was quite small and most cases seem to be common knowledge throughout the small department)My reputation was growing. Let me interject at this point that I had also encountered some very understanding and supportive officers too. The last one assigned to me was such a man. In court, he obviously struggled to tell the truth for my and his sake, but was, at the same time, was torn in the apparent presssure to be loyal to the force. My heart went out to him in court. My husband had taken whatever sources I had to apply for legal representation so I had to depend on a public defender. Needless, to say, in court the police officer who responded to my husband's call was believed to be telling the truth because he was a "police officer". He said what he had to say and walked off the stand and out the door with a smug, satisfied look and didn't look back. I went to physiotherapy for one year and had to stop the suceeding year due to rising gas prices. It took almost almost three years for me to be able to raise my arms above my head. The pain has lasted longer. He accused me of spontaneously attacking him with my fist which led him to twist my arms out of joint to protect himself. Being a student of the human thinking and having a strong handle on psychology, I assessed him upon seeing him in his initial approach of the house and interaction towards his fellow officer and my ex-husband. I decided not to look at him, approach him verbally or act in any manner that he would interpret as reason for reaction. My training in psychology taught me that a "power job" such as police work and politics is based in the sexual drive. Of course, not all law enforcement has that motivation but the psychologically predisposed will very often take that to the limits and abuse their position of power. I experienced a large level of dishonesty and male ego over a number of years living in that area. It was covered by a self-righteous and religious fascade (the other good ole boy group that binds). I heard of others who had been through similar experiences - usually women and minorities. Investigation into an outwardly honest town government could uncover a great deal of abuse - both monetary (an inordinate increase of town income through fines and a non-stop quilty findings in minority cases. This, by no means, has been a discussion, but more of a treatise supporting my feelings towards the unfair inversive "just-because" trust in police officers' statements as apposed to those of the public. C KC: Dear C: While the majority of police officers are good people trying to do a tough job, there are those, as you say, who get into it for the wrong reason and want the badge for its power. I'm sorry all this happened to you, and I do hope that your arm heals and you're now in a better place **** Joseph Kent McGowen is still in jail, his parole in 2007 was denied. KC: Very true. Vandiver covers Robert Johnson, Leadbelly, Randy Newman, Bob Dylan, and more on this disc, but the three originals are purely pleasurable. Vandiver was able to wrap his talent around a song like no other. If the worst happens and David Temple succesfully appeals his conviction and goes free before your book is done, does that mean you will have to scrap the project or will the book be written regardless of what the court of appeal does? KC: Hey All: No movie on SWIA. Wish there was. It is a truly great story. On the Borchardt case, it is a fascinating one, but there's been so much on it, including a movie with Ann Margaret, that I think I'll pass. But thanks for the suggestion. It's appreciated! KC: Wow. Lots of questions. LOL It all depends on the circumstances. I'll be watching like you are to see what the appeals court decides. **** Actually scratch my previous question. I know you're not inclined to answer right now your personal thoughts about the verdict, so I'm going to ask something you can answer. Do you think there was enough evidence to legally support the verdict? On appeal his attorneys will likely argue there was insufficient evidence and the judge should have entered a directed verdict. Do you think there's any chance that an appeals court will reverse the verdict and free Temple, or do you believe that's unlikely? Hi Katherine. I followed the Temple trial and agree with the verdict, but I would have understood an acquittal due to the nature of the evidence. So my question to you is since you sat in and heard all the evidence presented what would your verdict have been if you had been on the jury? KC: You know, those are all interesting points and good questions. I don't have an answer, however. I've learned over the years never to predict what an appeals court will do. They've surprised me too many times. We're all going to have to hang in there and wait to see what happens. *** Katherine. Since the formula for methamphetamine is different from amphetamine, my guess is that Adderall doesn't show up as meth on autopsy, but that's a guess. I start researching the books not knowing if I believe the person is guilty or innocent. Police, prosecutors, and juries do make mistakes. But you're right; if I investigate and come to the conclusion that someone has committed a horrible crime, it does make me angry. For too many people, life is cheap. They kill over a bit of money or to satisfy their selfish needs. I find such criminals reprehensible. ***** I watched the Laura Hall case on 48 hours last night and something about it bothered me. As a result, I have been researching it all day. The second bullet that was shot, obviously, was intended to get rid of the dental work. So who fired the second shot? The guy went to his neighbor's house to see if she heard the shot or shots. If his comment to her was that he fired two shots, it sounds like to me that the two shots were fired before 3 am that morning. Doesn't this prove that he is the one solely responsible for the mutilation of the body, not Laura Hall? I think she is guilty by association and I do think that she helped him attempt to clean up the murder (obviously two of the things she touched were the gun and the flip flops). Furthermore, I believe that she should have gotten more time based on the circumstances. On the flip side, Laura Hall could have instructed him to mutilate the corpse and fire the second bullet to damage the dental evidence. She would have known that he told the neighbor about the firing of two shots not one. It almost seems that the murder was an accident by a person who was whacked out, but the mutilation was orchestrated by someone very calculating. The testimony by the neighbor of the two shots seems to be the most important piece of evidence in determining a timeline of what happened that night, and would be crucial in possibly clearing Laura Hall of the evidence tampering conviction. Just my thoughts. KC: You've put a lot of thought into this, but I'm afraid you have some bad info. What Colton told the neighbor was that there had been a gun battle with drug dealers at his apartment, indicating there were multiple shots, not specifically mentioning two. I'd rather not discuss all the rest of the evidence here, because it will spoil the book for some folks. I'm sure you understand. You don't have to wait too long. The appeal is next week, and what the judges will consider is his request for a new trial. If they decide in his favor, the Travis County DA will have to retry Colton. In front of the appeal's court, Colton's appeal attorney will argue many of the same grounds his attorneys argued during the trial.
